1. Acceptance of Terms
By accessing or using the Cadence web application (the "Service") operated by Cadence ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.
We reserve the right to update these Terms at any time. Material changes will be communicated via the Service or email. Your continued use after changes constitutes acceptance of the revised Terms.
2. Description of Service
Cadence is an AI-powered content generation and scheduling tool for X (Twitter). The Service:
- Analyzes your publicly available tweets to build a writing persona.
- Generates draft tweets using artificial intelligence (Anthropic Claude).
- Allows you to review, edit, approve, and post content to your X account.
- Provides optional automated scheduling ("Autopilot") to post pre-approved content.
- Offers auxiliary tools such as hook scoring, viral rewriting, reply generation, and thread creation.
3. Eligibility
- You must be at least 18 years old to use the Service.
- You must have a valid X (Twitter) account in good standing.
- You must have the legal authority to bind yourself to these Terms.
- You are responsible for ensuring your use of the Service complies with all laws applicable in your jurisdiction.
4. Account and X (Twitter) Authorization
- You authenticate via X OAuth 2.0. You are responsible for maintaining the security of your X account credentials.
- By connecting your X account, you authorize Cadence to: (a) read your public tweets, (b) post content you have approved, and (c) access public trending topics and engagement metrics.
- You may revoke Cadence's access at any time via X Settings > Security > Apps and sessions. Revoking access will disable posting and persona features.
- You are solely responsible for all activity that occurs through your Cadence account.
5. AI-Generated Content — Your Responsibility
THIS IS A CRITICAL SECTION. PLEASE READ CAREFULLY.
- Content review obligation: All AI-generated content is provided as drafts for your review. You are solely and fully responsible for reviewing, editing, and approving any content before it is posted to your X account. Cadence does not post content without your approval (either manual approval or pre-configured Autopilot approval).
- No guarantees on content quality: AI-generated content may be inaccurate, incomplete, misleading, inappropriate, offensive, or factually incorrect. We make no representations or warranties regarding the quality, accuracy, legality, or suitability of any generated content.
- Compliance with X's rules: You are solely responsible for ensuring that all content posted through the Service complies with X's Terms of Service, Rules, and policies, including but not limited to rules on spam, manipulation, impersonation, hateful conduct, and misleading information. Cadence does not monitor or filter content for compliance with X's policies.
- Account consequences: Posting content that violates X's policies may result in warnings, restrictions, suspensions, or permanent bans on your X account. Cadence bears no responsibility whatsoever for any actions taken by X against your account, including but not limited to account suspension, restriction, shadow-banning, or permanent ban, regardless of whether the content was generated by our Service.
- Automated posting risks: If you enable Autopilot, you acknowledge that content will be posted automatically based on your pre-set schedule and approval preferences. You accept full responsibility for all automatically posted content. We strongly recommend using the "Preview before posting" setting.
- No liability for third-party consequences: Cadence is not liable for any consequences arising from content posted through the Service, including but not limited to: loss of followers, reduced engagement, negative public perception, legal claims from third parties, regulatory action, or any other damages.
6. Acceptable Use
You agree NOT to use the Service to:
- Generate or post content that is illegal, defamatory, harassing, threatening, obscene, or that infringes on any third party's intellectual property rights.
- Engage in spam, platform manipulation, artificial engagement inflation, or coordinated inauthentic behavior as defined by X's policies.
- Impersonate other individuals, brands, or entities.
- Generate or distribute misinformation, disinformation, or deceptive content.
- Circumvent rate limits, usage caps, or other restrictions imposed by the Service or X's API.
- Reverse-engineer, decompile, or attempt to extract the source code or AI models used by the Service.
- Share, resell, or redistribute your account access to third parties.
- Use the Service in any way that violates applicable local, state, national, or international laws.
We reserve the right to suspend or terminate your account immediately and without notice if we determine, in our sole discretion, that you have violated these terms.
7. Subscription and Payments
- Free trial: New users receive a 3-day free trial with access to all features, subject to daily usage limits. No payment information is required for the trial.
- Paid plans: Paid subscriptions (Starter, Pro) are billed monthly through Lemon Squeezy. Pricing is displayed at the time of purchase and may change with 30 days' notice.
- Usage limits: Each plan includes a daily limit on posts made through the X API (tweets, replies, threads). Generation of draft content is subject to separate limits. Limits are enforced per calendar day (UTC).
- Automatic renewal: Subscriptions renew automatically each billing cycle. You may cancel at any time. Cancellation takes effect at the end of the current billing period.
- Refunds: Subscription fees are generally non-refundable. If you believe you were charged in error, contact us within 14 days of the charge.
- Plan changes: Upgrading takes effect immediately. Downgrading takes effect at the next billing cycle.
8. Intellectual Property
- Your content: You retain all rights to content you create, edit, and post through the Service. By using the Service, you grant Cadence a limited, non-exclusive license to process your content solely for the purpose of providing the Service (e.g., storing drafts, posting to X on your behalf).
- AI-generated content: Content generated by the AI is provided to you for your use. You may use, modify, and post it freely. However, AI-generated content may not be unique — similar content may be generated for other users based on similar inputs.
- Our Service: The Cadence application, including its design, code, features, and branding, is our intellectual property. You may not copy, modify, or distribute any part of the Service without our written permission.
9. Third-Party Services
- The Service integrates with X (Twitter), Anthropic Claude, Lemon Squeezy, Supabase, and Vercel. Your use of these third-party services is subject to their respective terms and privacy policies.
- We are not responsible for the availability, accuracy, or conduct of any third-party service.
- Changes to X's API, terms, pricing, or policies may affect the availability or functionality of the Service. We are not liable for any disruption caused by third-party changes.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:
- Merchantability, fitness for a particular purpose, and non-infringement.
- That the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components.
- That AI-generated content will be accurate, appropriate, original, non-infringing, or compliant with any platform's rules.
- That using the Service will increase your followers, engagement, or reach on X.
- That your X account will not be subject to restrictions, suspensions, or bans.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Cadence, its owners, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, data, goodwill, reputation, X account access, social media followers, or business opportunities.
- Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater.
- This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
- Specifically, we are not liable for:
- Any action taken by X/Twitter against your account, including suspension or ban.
- Content generated by AI that is inaccurate, offensive, or violates third-party rights.
- Loss of data due to system failures, third-party outages, or security incidents.
- Any consequences of automated posting via the Autopilot feature.
- Changes to X's API, pricing, or policies that affect the Service.
12. Indemnification
You agree to indemnify, defend, and hold harmless Cadence, its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:
- Your use of the Service.
- Content you generate, approve, edit, or post through the Service.
- Your violation of these Terms or any applicable law.
- Your violation of X's Terms of Service or any third party's rights.
- Any claim by a third party related to content posted from your X account via the Service.
13. Account Termination
- By you: You may delete your account at any time from Settings > Danger Zone. This permanently deletes all your data.
- By us: We may suspend or terminate your account at any time, with or without cause, with or without notice. Reasons include but are not limited to: violation of these Terms, abuse of the Service, non-payment, or legal requirements.
- Upon termination, your right to use the Service ceases immediately. We are not obligated to retain or provide your data after termination, except as required by law.
14. Dispute Resolution
- Informal resolution: Before filing any formal dispute, you agree to contact us and attempt to resolve the matter informally for at least 30 days.
- Arbitration: Any dispute not resolved informally shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall be conducted on an individual basis — class actions and class arbitrations are not permitted.
- Governing law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
- Waiver of jury trial: To the extent permitted by law, you waive any right to a jury trial in any proceeding arising from these Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Cadence regarding the Service and supersede all prior agreements, understandings, and communications.
